Touch Base Consulting provides digital marketing and consulting services including, but not limited to:
All quotations are valid for 30 days from the date of issue. Prices are quoted in South African Rand (ZAR) unless otherwise specified.
Project work requires a 50% deposit before commencement, with the balance due upon completion. Monthly retainers are payable in advance on the 1st of each month.
Invoices not paid within 7 days may incur interest at 2% per month. Services may be suspended until payment is received.
You retain ownership of all materials you provide to us (logos, images, content, trademarks).
Upon full payment, ownership of custom deliverables (website designs, content) transfers to you.
Portfolio Rights: We reserve the right to showcase completed work in our portfolio and marketing materials unless otherwise agreed in writing.
To ensure successful delivery of our services, you agree to:
Provide accurate and complete information, content, and materials in a timely manner
Respond to requests for feedback and approvals within 5 business days
Ensure you have the legal right to use any materials you provide
Grant necessary access to accounts, platforms, and hosting environments
Maintain backup copies of your own important data and content
While we strive for excellent results, we cannot guarantee specific search engine rankings, traffic levels, or business outcomes. Digital marketing results depend on many factors beyond our control.
We are not liable for issues caused by third-party platforms (Google, Meta, hosting providers, etc.) including changes to their algorithms, policies, or service interruptions.
Our total liability for any claims arising from our services shall not exceed the total fees paid by you in the 12 months preceding the claim.
Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This includes business strategies, customer data, login credentials, and financial information. This obligation continues for 2 years after the termination of services.
Monthly retainers may be cancelled with 30 days written notice.
Deposits for project work are non-refundable once work has commenced.
Upon termination, we will provide reasonable handover of assets and access credentials.
Either party may terminate immediately for material breach of these terms.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
